Terms of use - Voice of Ben Ari

1. General Provisions
1.1. These Terms and Conditions define the rules for the use by users (hereinafter referred to as the “User”) of the services and content provided by Voice of Ben Ari Publishing House (hereinafter referred to as the “Publisher,” “We,” or “Our”).
1.2. Use of the website and listening to audiobooks is permitted only with full acceptance of these Terms. If the User does not accept the Terms, they are not entitled to use the services.
1.3. We reserve the right to change the Terms at any time. The new version will take effect upon publication on the website, unless otherwise expressly stated.

2. Rights and obligations of the Publisher
2.1. Provide access to audiobooks after payment (or if you have a subscription) within 24 hours of payment confirmation.
2.2. Ensure the quality of audio files (recording, mastering, metadata, cover art), as well as timely updating of the catalog.
2.3. Maintain the confidentiality of the User's personal data and do not transfer it to third parties without consent, except in cases provided by law.
2.4. Inform Users of any changes to terms, subscriptions, prices, etc.

3. Rights and obligations of the User
3.1. The User undertakes to use audiobooks solely for personal, non-commercial purposes—to listen, not to distribute, not to transfer to third parties, and not to copy.
3.2. Purchase a subscription or individual work honestly and do not attempt to circumvent payment/security mechanisms.
3.3. Do not share your account information (login/password) with third parties.
3.4. Do not post, publish or distribute files received from the Publisher on other resources without written consent.

4. Copyright and Licenses
4.1. All content (audiobooks, voiceovers, metadata, covers) is the intellectual property of the Publisher or the corresponding copyright holders.
4.2. When purchasing a subscription or a single audiobook, the User is granted a non-inclusive, personal license to listen—without the right to further distribution, copying, public performance, adaptation, etc.
4.3. Any violation of rights—distribution, copying, public performance—becomes a violation of the terms and conditions, entailing liability under the law.

5. Subscription, payment and refunds
5.1. The user can subscribe or purchase a separate audiobook.
5.2. Payment is made through the payment system indicated on the website (Stripe, Payoneer and/or others).
After successful payment, access to the catalog or a specific file is provided within 24 hours.
5.4. Refunds are only possible in the event of a technical error with the service, such as a damaged file, inability to play, etc. Refunds are issued upon written request to the support email address.
5.5. If a subscription is cancelled, access remains until the end of the paid period, after which access is closed.

6. Limitation of Liability
6.1. We are not responsible for the device through which the User listens to the audiobook, for the quality of the Internet connection, for format incompatibility, for players, etc.
6.2 We do not guarantee that all books will be available in all countries due to licensing restrictions, regional rights, and other factors.
6.3. We are not responsible for the User's actions that violate copyright if such actions are committed by the User independently.

7. Protection of personal data and confidentiality
7.1. When registering/purchasing, we may request your email address, name, and other information only if necessary to process the payment and deliver services.
7.2 This data is not transferred to third parties, except when required by law or court order.
7.3. The user has the right to request the deletion of their personal data, in which case their account and access will be cancelled.

8. Termination of the Agreement
8.1. The Publisher reserves the right to suspend or terminate the User's access to the services in the event of a violation of the Terms, an attempt to distribute content, or fraud.
8.2. The User has the right to refuse to use the service; the agreement is terminated upon expiration of the paid period or upon the User's request.

9. Other provisions
9.1. These Terms are governed by the laws of the country of registration of the Publisher - Israel.
9.2. All disputes shall be resolved in the appropriate courts at the location of the Publishing House.
9.3. In case of invalidity of any clause, the remaining clauses shall remain in force.
